This program will begin by providing an overview of the regulatory process under the Administrative Procedures Act, including how to effectively comment and impact potential regulations at various stages of the process. Then, we will highlight some of the key proposed regulations on the current 80+ item regulatory agenda. Our discussion will include proposed regulations from the Employee Benefits Security Administration (EBSA), the Office of Federal Contract Compliance Programs (OFCCP), the Occupational Safety & Health Administration (OSHA), and the Wage & Hour Division (WHD). Some specific regulations we will discuss include the OSHA permanent standard on COVID-related protections in the workplace, the OFCCP regulations relating to preliminary determination notices and subcontractors, and the Wage & Hour regulations for joint employers.
