Seasonal Shortlist: Winter 2023 OFCCP Updates The new year brings a number of changes to Office of Federal Contract Compliance Programs (OFCCP) policies and practices. These changes include publication of a new list of contractors that will be audited in the coming months. As we predicted in the last seasonal shortlist webinar, the list is aimed for the first time this year at contractors that failed to certify to OFCCP that they had affirmative action programs in place. Likewise, the speakers take an in-depth look at the proposed expansion of information being requested by OFCCP when they schedule an audit, along with the recent practice to make more supplemental information requests during audits as well. Finally, the speakers discuss OFCCP's proposal to remove a number of regulations governing the standard it must meet to proceed with a discrimination claim and reducing how much information it provides to contractors in enforcement notices relating to that claim.
The new year also brings additional resources for contractors regarding diversity, equity, inclusion, and accessibility, including new federal guidance regarding disability discrimination and service member and veteran discrimination, neurodiversity in the workplace, and artificial intelligence.
