The FCPA prohibits the payment of bribes to foreign officials to assist in obtaining or retaining business. The FCPA has an extensive reach and can apply to prohibited conduct that occurs anywhere in the world. U.S. public companies and their officers, directors, employees, and agents are the statute’s main focus, but foreign entities with a nexus to, or presence in, the United States may also be at risk.
